1.
Scope
In
the case of orders via the website of Lesama Marcin Piotr Gaska,
Jesrzego Popieluszki 12/18 10-693 Olsztyn - hereinafter referred to
as "BestWater" - the following General Terms and Conditions
(GTC) apply. The customer's terms and conditions do not apply, even
if Lesama and BestWater have not expressly denied them.
2.
Conclusion of the contract
2.1.
The presentation of the products on the website does not constitute a
binding offer to conclude a purchase contract.
2.2.
The purchase contract is concluded by placing an order by the
Customer and subsequent acceptance of the order by BestWater. Orders
can be placed by clicking the "Order with obligation to pay"
button in the online store or by sending a written inquiry via the
contact form.
2.3.
In the case of physical goods, Lesama Marcin Piotr Gaska first sends
an order confirmation to the e-mail address provided by the Customer
after receiving the order. This order confirmation does not yet
constitute acceptance of the Customer's offer, acceptance only occurs
when the goods are shipped to the Customer.
2.4.
In the case of digital products for download, the order is accepted
by providing a download link in the form of a clickable button in the
online store or by sending a hyperlink to the Customer by
e-mail.
2.5.
Lesama Marcin Piotr Gaska and BestWater have the right to refuse
to accept an order without giving a reason.
3.
Shipping costs
3.1.
Lesama Marcin Piotr Gaska takes over the shipping costs of
drinking water systems in Poland. The buyer bears the costs of
shipping other goods within Poland. In the case of shipment abroad,
the Customer bears all shipping costs, in particular shipping costs,
customs duties and other fees.
3.2.
Any shipping costs will be shown separately in the shopping cart
before placing a binding order.
4.
Delivery
4.1.
If delivery of the goods within the time specified on the website is
not possible and the delivery time exceeds one week, the Customer has
the right to withdraw from the contract.
4.2.
In the event of a shortage of goods, Lesama Marcin Piotr Gaska will
immediately inform the Customer about this fact and refund the
payments made.
4.3.
In the case of downloadable products, the contract is fulfilled by
BestWater when an executable download link is made available to the
customer once.
5.
Reservation of title
5.1.
The delivered goods remain the property of BestWater until full
payment is made.
5.2.
The customer is obliged to carefully handle the goods for which he
has not yet been fully paid and to have them repaired in a timely
manner at his own expense, in accordance with BestWater's maintenance
instructions.
6.
Warranty and warranty
6.1.
If the goods have defects that significantly impede use in accordance
with the contract, the customer is initially only entitled to
supplementary performance. BestWater may remove the defect by
delivering a defect-free item or improving an item already delivered.
The repair is considered failed at the earliest after the second
failed attempt. The customer then has the option to reduce the
contract or withdraw from it.
6.2.
Notwithstanding the statutory liability for material defects,
BestWater grants its customers a 30-year warranty for the Jungbrunnen
66-00, 66-10, 66-11 and 33-00 filter systems under the conditions
listed below. The warranty applies to all parts of these systems,
except electrical and electronic parts, booster pump, permeate pump,
taps and seals. The warranty does not apply to commercial or
industrial use of the systems.
With
a daily consumption of more than 100 liters of filtered water
(permeate) or a total annual volume exceeding 36,500 liters,
commercial or industrial use can be assumed.
6.3.
The warranty applies only if original BestWater spare parts are used
and replaced regularly depending on the individual intensity of use
and degree of dirt, but at least at the following intervals:

5 µ sediment filter every 6 months

Activated carbon filter every 12 months

Sediment filter 1 µ every 12 months

Mineral filter every 12 months
-
High-efficiency energy module every 3 years.
6.4.
The warranty does not apply if the system is not put into operation
within 14 days from the date of delivery and then maintained in
continuous operation.
6.5.
The warranty also expires in the event of incorrect and improper use
or if the installation of the system/fountain of youth was not
carried out professionally and in accordance with the information
contained in the operating and installation manual. The warranty only
applies if the system/fountain of youth is connected to a cold water
connection that complies with the limit values of the German Drinking
Water Ordinance.
6.6.
If the system is resold, the warranty can only be transferred with
the consent of BestWater.
6.7.
To make a warranty claim, the goods must be returned after prior
consultation via e-mail or the shipping form
