1. Scope
The following General Terms and Conditions (T&C) apply to orders placed via the website of Lesama Marcin Piotr Gaska (www.bestwoda.com), ul. Michała Kajki 10/12, 10-547 Olsztyn – hereinafter referred to as “BestWater.” Customer terms do not apply, even if Lesama and BestWater have not explicitly objected to them.
2. Formation of the Contract
2.1. The presentation of products on the website does not constitute a binding offer to conclude a purchase agreement.
2.2. A purchase agreement is concluded when the customer places an order and BestWater subsequently accepts the order. Orders can be placed by clicking the "Order with obligation to pay" button in the online store or by submitting a written inquiry via the contact form.
2.3. For physical products, Lesama Marcin Piotr Gaska will initially send an order confirmation to the email address provided by the customer after receiving the order. This order confirmation does not yet constitute acceptance of the customer's offer; acceptance occurs only upon the shipment of the product to the customer.
2.4. For digital download products, the order is accepted by making a download link available in the form of a clickable button in the online store or by sending a hyperlink to the customer via email.
2.5. Lesama Marcin Piotr Gaska and BestWater reserve the right to decline an order without providing a reason.
3. Shipping Costs
3.1. Lesama Marcin Piotr Gaska covers the shipping costs for drinking water systems within Poland. The buyer bears the shipping costs for other products within Poland. For international shipments, the customer is responsible for all shipping costs, including customs duties and other fees.
3.2. Any applicable shipping costs will be shown separately in the shopping cart before the binding order is placed.
4. Delivery
4.1. If delivery of the product within the timeframe indicated on the website is not possible and the delivery time exceeds one week, the customer has the right to withdraw from the contract.
4.2. In the event of product unavailability, Lesama Marcin Piotr Gaska will inform the customer promptly and refund any payments made.
4.3. For downloadable products, the contract is fulfilled by BestWater at the moment an active download link is made available to the customer.
5. Retention of Ownership
5.1. Delivered goods remain the property of BestWater until full payment has been made.
5.2. The customer is obligated to handle goods that have not yet been fully paid for with care and to arrange timely repairs at their own expense, following BestWater’s maintenance instructions.
6. Warranty
6.1. If goods have defects that significantly impair their use as intended, the customer is initially entitled only to supplementary performance. BestWater may remedy the defect by delivering a defect-free item or by improving the delivered item. Repairs are considered unsuccessful only after the second failed attempt. The customer may then reduce the contract value or withdraw from the contract.
6.2. In addition to statutory liability for material defects, Lesama Marcin Piotr Gaska offers its customers a 2-year warranty on Jungbrunnen 66-00, 66-10, 66-11, and 33-00 filtration systems under the conditions listed below. The warranty covers all parts of these systems except electrical and electronic components, booster pumps, permeate pumps, faucets, and seals. The warranty does not apply to commercial or industrial use of the systems. If daily consumption exceeds 100 liters of filtered water (permeate) or the total annual volume exceeds 36,500 liters, commercial or industrial use is assumed.
6.3. The warranty is valid only when original BestWater spare parts are used and replaced regularly according to the intensity of use and degree of contamination, but at least at the following intervals:
- 5 µ sediment filter: every 6 months
- Activated carbon filter: every 12 months
- 1 µ sediment filter: every 12 months
- Mineral filter: every 12 months
- High-performance energizing module: every 3 years
6.4. The warranty does not apply if the system is not put into operation within 14 days of delivery and is not maintained in continuous operation.
6.5. The warranty also expires in the event of improper or inappropriate use or if the system/fountain of youth is not professionally installed in accordance with the operating and installation instructions. The warranty applies only if the system/fountain of youth is connected to a cold water supply that meets the limit values of the German Drinking Water Ordinance.
6.6. In the case of resale of the system, the warranty can only be transferred with the consent of BestWater.
6.7. To make a warranty claim, goods must be returned after prior consultation via email or the contact form in our store.
